Durante todos esos a\u00f1os, su antiguo empleador solo pagaba a la esposa Nancy, aunque tanto Nancy como Manuel proporcionaban los servicios de conserjer\u00eda.  Mientras Nancy y Manuel hab\u00edan sido pagados por hora, en 2010 la gerencia de su empleador emiti\u00f3 un memorando indicando que la pareja ser\u00eda pagada por evento en adelante y dej\u00f3 de seguir las horas que trabajaban. \u00a0<\/p>\n\n\n\n<p>Inicialmente, el abogado del empleador argument\u00f3 que los Estay eran contratistas independientes, sin embargo, a la luz de la decisi\u00f3n de <em>Dynamex <\/em>el empleador no argument\u00f3 la clasificaci\u00f3n err\u00f3nea en la audiencia.
