El primer acuerdo en el caso del Centro para los <\/span><a href=\"https:\/\/www.rightscenter.org\/our-work\/edd-notice-of-class-settlement\/\"><i><span style=\"font-weight: 400;\">Derechos de los Trabajadores contra el EDD<\/span><\/i><\/a><span style=\"font-weight: 400;\"> result\u00f3 en la creaci\u00f3n de los Pagos Condicionales, garantizando las prestaciones del Seguro de Desempleo a m\u00e1s de 590.000 solicitantes cuyos pagos hab\u00edan sido congelados mientras el EDD investigaba, lo que sospechaba, \"solicitudes fraudulentas\". Accedieron a m\u00e1s de 711 millones de d\u00f3lares los trabajadores que ten\u00edan sus solicitudes congeladas previamente como \"pendientes\".\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ahora, 19 meses despu\u00e9s, CWR ha firmado otro acuerdo con el EDD. A partir de ahora, el EDD deber\u00e1 anular todos los avisos de sobrepago emitidos extempor\u00e1neamente a los solicitantes despu\u00e9s del plazo legal para solicitar el reembolso. Debido al elevado volumen de reclamaciones durante la pandemia, el EDD retras\u00f3 en muchos casos la determinaci\u00f3n del derecho a las prestaciones, incluso mientras pagaba las prestaciones reclamadas. Aunque este proceso acelerado proporcion\u00f3 fondos que los trabajadores desempleados necesitaban desesperadamente durante el par\u00f3n econ\u00f3mico de Covid-19, el EDD nunca inform\u00f3 a esos reclamantes de que se reservaba el derecho a revisar m\u00e1s adelante su base de elegibilidad y exigirles que devolvieran los pagos de UI, a menudo considerables, que ya hab\u00edan recibido.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Adem\u00e1s, este Acuerdo de Conciliaci\u00f3n establece que los solicitantes a los que se les hayan terminado los a\u00f1os de beneficios al expirar los programas federales el 4 de Septiembre de 2021 y que a\u00fan no hayan recibido una Notificaci\u00f3n de Pago en Exceso no tendr\u00e1n que devolver los beneficios ya recibidos a menos que el EDD determine que el solicitante incurri\u00f3 en fraude, tergiversaci\u00f3n o falta de revelaci\u00f3n intencionada.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Esta victoria llega en un momento en el que muchos trabajadores a\u00fan se est\u00e1n recuperando econ\u00f3micamente de la pandemia, y aliviar\u00e1 a miles de trabajadores del estr\u00e9s a\u00f1adido de tener que pagar prestaciones adicionales que recibieron sin tener culpa alguna.
