Mientras participaba en una feria de empleo de la comunidad, el CWR conoci\u00f3 a Audrey Eaton, que era una trabajadora temporal contratada por varias oportunidades de empleo en la regi\u00f3n de Sacramento. Durante la conversaci\u00f3n, Audrey nos cont\u00f3 que ten\u00eda problemas para acceder a los beneficios del seguro de desempleo y que eso le causaba una gran ansiedad porque no ten\u00eda ingresos para pagar sus facturas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cuando el CWR revis\u00f3 los detalles del caso de la Sra. Eaton, qued\u00f3 claro que su descalificaci\u00f3n de beneficios del seguro de desempleo se debi\u00f3 a que el EDD malinterpret\u00f3 su historial laboral.  Como trabajadora temporal, la Sra. Eaton trabaj\u00f3 para muchos empleadores diferentes, algunos durante un periodo de tiempo muy corto. Entre un empleo y otro, pod\u00eda acceder a los beneficios del seguro de desempleo. Sin embargo, cuando la agencia de trabajo temporal la despidi\u00f3 y preve\u00eda que iba a estar desempleada durante m\u00e1s tiempo, el EDD no se fij\u00f3 en su empleo m\u00e1s reciente para evaluar su derecho a prestaciones y, en su lugar, se remont\u00f3 a un empleo muy breve tras el cual no solicit\u00f3 beneficios.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este error se debi\u00f3 a que el EDD no realiz\u00f3 la entrevista de elegibilidad programada. El CWR alert\u00f3 al EDD de este error con la esperanza de que corrigieran su error y determinaran que la Sra. Eaton reun\u00eda los requisitos sin necesidad de apelar, pero el EDD no hizo nada. En cambio, el CWR colabor\u00f3 con CUIAB para acelerar la audiencia sobre su descalificaci\u00f3n de los beneficios y evitar el plazo de espera de 26 semanas. En la audiencia, el juez administrativo determin\u00f3 que Audrey ten\u00eda derecho a los beneficios que hab\u00eda recibido y anul\u00f3 la inhabilitaci\u00f3n sobre el historial laboral anterior, lo que permiti\u00f3 que su solicitud actual de beneficios siguiera adelante.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Desde el inicio de la pandemia miles de trabajadores se les han negado sus beneficios de desempleo o se les han rescindido despu\u00e9s de los hechos debido a malentendidos, falsas acusaciones de comportamiento fraudulento, o la falta de comunicaci\u00f3n de parte de EDD. CWR ha ganado varias victorias significativas para los trabajadores en lo que respecta al seguro de desempleo, tales como los pagos condicionales, y nuestro reciente acuerdo exitoso que ha eliminado la necesidad de miles de trabajadores a devolver los beneficios que recibieron. El caso de la Sra. Eaton no es \u00fanico, pero gracias a que pudo reunirse con nuestros expertos en desempleo del Centro de Derechos Laborales, pudo llegar m\u00e1s r\u00e1pidamente a la audiencia y acceder a las prestaciones del seguro de desempleo.
