Firmada por el Gobernador en Septiembre de 2019, y promulgada el 1 de Enero, la AB 5 codifica la \"prueba ABC\" para determinar si alguien es o no un empleado o un contratista independiente.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bajo esta prueba un trabajador NO es considerado un contratista independiente a menos que el empleador satisfaga las tres condiciones siguientes:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">El trabajador est\u00e1 libre del control y la direcci\u00f3n de la entidad contratante en relaci\u00f3n con la realizaci\u00f3n del trabajo, tanto bajo contrato para la realizaci\u00f3n del trabajo de hecho;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">El trabajador realiza un trabajo que est\u00e1 fuera del curso habitual del negocio de la entidad contratante; y<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">El trabajador se dedica habitualmente a un oficio, ocupaci\u00f3n o negocio establecido de forma independiente de la misma naturaleza que el implicado en el trabajo realizado.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Una gran cantidad de trabajadores con salarios bajos reciben a veces una compensaci\u00f3n incorrecta porque han sido clasificados incorrectamente. Los empresarios utilizan esta clasificaci\u00f3n incorrecta para eludir las leyes sobre salarios y horarios que protegen la capacidad de un trabajador para asegurarse el pago de horas extraordinarias, prestaciones y otras normas m\u00ednimas en el lugar de trabajo. Desde que se aprob\u00f3 la AB 5, los trabajadores han sido informados de que sus empleadores est\u00e1n revisando sus clasificaciones como contratistas independientes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En un esfuerzo por prestar apoyo a esta legislaci\u00f3n y a su aplicaci\u00f3n continuada, el CWR se uni\u00f3 a otras organizaciones laborales, coordinadas por la Federaci\u00f3n Laboral de California, para informar a los miembros de la legislatura sobre el importante impacto que este proyecto de ley est\u00e1 teniendo en los trabajadores con salarios bajos.
