Julio Santos Guzm\u00e1n, trabajador del sector de la construcci\u00f3n en Sacramento, llam\u00f3 al Centro para los Derechos Laborales porque su empleador no le pagaba los d\u00edas que se tomaba libres cada a\u00f1o para su tratamiento de di\u00e1lisis.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Los empleados que trabajen m\u00e1s de 90 d\u00edas para una empresa tienen derecho a acumular d\u00edas libres por enfermedad pagados a raz\u00f3n de una hora por cada 30 horas trabajadas y est\u00e1n obligados a proporcionar a sus empleados un m\u00ednimo de 24 horas (3 d\u00edas) de tiempo libre por enfermedad al a\u00f1o. Adem\u00e1s, se proh\u00edbe a los empresarios restringir el momento en que los empleados utilizan su tiempo de enfermedad pagado acumulado y no pueden disciplinar a sus empleados por utilizar su tiempo de enfermedad. La ley tambi\u00e9n exige que los empleadores faciliten el tiempo acumulado de enfermedad a disposici\u00f3n del empleado en su tal\u00f3n de pago, o en un documento aparte facilitado el mismo d\u00eda del pago del salario.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Desde la primera conversaci\u00f3n entre CWR con el trabajador Julio en el 2020, vimos que el empleador de Julio no estaba cumpliendo con la ley. Julio nunca recibi\u00f3 pago por el tiempo que se ausent\u00f3 para di\u00e1lisis y ninguno de sus talones de pago mostraba pago por enfermedad acumulado.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Presentando una reclamo ante la oficina del Comisionado Laboral, Julio pudo solicitar el pago de todos sus tratamientos de di\u00e1lisis y las multas relacionadas.  El 15 de agosto de 2023, el Comisionado Laboral estuvo de acuerdo en que el empleador de Julio hab\u00eda violado la ley y tom\u00f3 una decisi\u00f3n requiriendo que su empleador pagara las cantidades reclamadas. Se necesita una enorme fuerza de voluntad para que los trabajadores se enfrenten a sus empleadores, que a veces los ponen en el punto de mira de las represalias o incluso del despido.
