Wood Cutter Awarded Overtime Wages

On August 10,2015, Hearing Officer Patricia Oviedo of the Stockton Labor Commissioner office awarded Center for Workers’ Rights client nearly $27,000 in wages and penalties as a result of the employer’s failure to pay overtime wages.


The Center’s client described deplorable working conditions, where management used scare tactics to keep workers obedient.  Our client finally grew tired of the conditions and resigned.  During his entire period of employment, he was paid a flat rate for work and was not compensated for overtime, despite the long hours. The employer did not keep records of hours worked and paid a third of the weekly wages in cash.


Because of the lack of evidence from the employer, the Labor Commissioner awarded the full amount of wages requested.  The Center continues to represent the worker to help in collecting the wages owed.
